Palawan, Philippines – In a significant move to protect and preserve the natural beauty of one of Palawan’s prized treasures, the Palawan Council for Sustainable Development (PCSDS) has taken a decisive step by filing criminal charges against individuals involved in unauthorized activities within Pukaway Cave. This recent development underscores the critical importance of safeguarding the ecological balance and cultural significance of such natural wonders, as mandated by Republic Act No. 9072, also known as the National Caves and Cave Resources Management and Protection Act.

On October 6, 2023, the PCSDS initiated legal action against those responsible for conducting activities within Pukaway Cave without proper permits and in violation of Section 7, paragraph 1 of the aforementioned act. Pukaway Cave had garnered significant attention as a burgeoning tourist destination earlier this year. Pukaway cave is a cave system in Coron Island near and around Kayangan Lake and Barracuda Lake.

However, a series of cave inspections, conducted by the Department of Environment and Natural Resources (DENR) – Calamian Staff since 2021, has uncovered disconcerting evidence of damage to the cave’s speleogem or speleothem formations and alterations to the natural flow of wildlife.

The PCSDS Legal Services Section, in collaboration with the Environment and Natural Resources Office of the Municipality of Coron (EZMED), meticulously documented the illicit activities and environmental harm. Furthermore, administrative cases were also filed by the PCSDS and the National Commission on Indigenous Peoples (NCIP), emphasizing the urgency of addressing the situation. The Local Government Unit (LGU) of Coron expressed its concern, stating that the project had been initiated without proper coordination and documentation.

This legal action is grounded in the belief that the preservation of cave resources is not only a legal mandate but also a moral responsibility. As stated in the National Caves and Cave Resources Management and Protection Act, it is the declared policy of the State to conserve, protect, and manage cave resources as part of the country’s natural wealth.
